Terms of Use of Bike Parking

1 Overview of the Bike Parking Service

This agreement sets out the Terms of Use (hereinafter ‘Terms of Use’) on which the user may use the Bike Parking Service (hereinafter also ‘Service’).

Bike Parking is a Park & Ride Service for bicycles provided by Helsinki Region Transport (HSL). This Service allows the use of Bicycle Garages maintained by HSL's partner Service Providers. Customers who have activated the Service can link an identifier to their account, which grants access to all Bicycle Garages operated by the Service Providers. 

Bicycle Garages are locked facilities maintained by HSL’s partner Service Providers. Access is limited to individuals registered as users of HSL's Bike Parking Service (hereinafter also ‘User’).

In the Bicycle Garages, bikes are secured with the User's own lock, and the storage of bikes in the Garage is at the User's responsibility. The Bike Parking Service aims to enhance the security of facilities used for bike storage. Bicycle Garages are equipped with surveillance cameras. If a crime is suspected, the footage will be provided to the police following standard procedures after a police report has been filed.  

The locations of Bicycle Garages are listed on HSL's website at hsl.fi.

These Terms of Use apply to all content of the Service unless otherwise specified or agreed upon. Each Bicycle Garage has its own specific rules that Users must follow.

The Users must accept these Terms of Use as binding to use the Service.

The Service Users must be at least 15 years old, successfully registered as a User, and have accepted the current Terms of Use. The Service cannot be used without accepting the Terms of Use. The right to use the Service can be revoked as specified in the Terms of Use.

2 Terms used

Bike Parking is a Park & Ride service for bicycles provided by Helsinki Region Transport (HSL). This service allows the use of Bicycle Garages maintained by HSL's partners.

A User is a customer who uses the Bike Parking service and has approved the Service Terms of Use.

Bicycle Garage is a locked facility maintained by HSL’s partner Service Providers. Access is limited to individuals registered as Users of HSL's Bike Parking Service.

A Service Provider is a partner of HSL responsible for maintaining a Bicycle Garage.

Google Wallet is a digital wallet that enables users to store and use payment cards, loyalty cards, tickets, and other documents on their Android phones. Google Wallet can be downloaded from the Google Play Store on your phone. To use Google Wallet, the NFC (Near Field Communication) feature must be enabled on your phone.

Identifier: In the Bike Parking Service, Users can select the identifier they want to use to open the Bicycle Garage doors. The Identifier can be the User’s HSL card or the HSL Bike Parking Identifier (Hereinafter ‘HSL Identifier’), which can be added to Google Wallet.

3 Responsibility for the Service

HSL is responsible for the registration process for the Bike Parking Service, HSL accounts, the hsl.fi website, the HSL app, implementing Google Wallet, the HSL Identifier readers at the Bicycle Garage doors, and the administration and supervision of the Bike Parking Service.

HSL’s partner Service Providers, who maintain the Bicycle Garages, are responsible for all other aspects related to the use and maintenance of the Bicycle Garages. This includes the Bicycle Garage rules, opening hours, and communicating them to users, as well as the bike racks in the Bicycle Garages, cleaning, security, and the operation of the door devices.

4 Registration, personal data and use of the Service

In order to use the Service, a person must register as a User of the Service on the Service website or the HSL app.

When registering, the User must provide the necessary information required to use the Service. HSL has the right to process the User’s personal data in accordance with the EU’s General Data Protection Regulation (679/2016) and other applicable laws, as well as in the ways described in the Service's Privacy Statement.

The information provided by the User may be used in statistics in such a way that individual Users cannot be identified. The statistics are used to improve the service and analyze its use. HSL may also use the User's contact information to communicate with them.

Once HSL has approved a person's registration as a User of the Service, the User is granted the right to use the Service in accordance with these Terms of Use.

The User must create an HSL account (at hsl.fi or via the HSL app) and authenticate strongly, if they do not yet have a strongly authenticated account. If online authentication fails, the User can authenticate at the HSL service point. With the HSL account, Users can register for the service. After accepting the Terms of Use, the User can add an identifier used to access the Bicycle Garages.

The identifier can be the User’s HSL card or the HSL Identifier, which can be downloaded to Google Wallet. To use the HSL card as an identifier, the User must set a PIN code of their choice. The HSL card used as an identifier and the associated PIN code can be changed in the Bike Parking Service. The HSL card used as an identifier can be removed from the Service at any time.

The Google Wallet HSL Identifier can be used on devices where it is installed. For security reasons, using the Google Wallet HSL Identifier generally requires unlocking the phone or other device, depending on the model and its settings. 

Users can view and edit their information on the HSL app or the Service’s website.

HSL or HSL’s partner Service Provider, maintaining the Bicycle Garage, is not liable for any damages resulting from the use of the Service.

The User is responsible for all use of the Service occurring with their credentials, as well as for any costs and other obligations that may arise. The User must not intentionally allow other people to enter a Bicycle Garage. 

The User can cancel their registration as a User on the HSL app and the Service's website.

The Service is governed by HSL’s Privacy Statement.

5 Availability and content of the Service

The Service is available 24/7. Users can view and edit their information in the Service. The Service may be temporarily closed during exceptional circumstances. The opening hours, rules, and communications regarding these, as well as the racks and fixtures in the Bicycle Garages, are managed by the Service Providers responsible for each Bicycle Garage location. The Service Provider cannot be held liable for any deficiencies or issues related to the above or other flaws in the Service.

HSL develops the Service and reserves the right to modify it and its content as part of its normal operations, in the manner and at the times it deems fit.

HSL does not guarantee the error-free and uninterrupted operation of the Service. HSL is not liable for any service interruptions or other similar disturbances and errors, nor for damages that may arise from them. Additionally, HSL is not liable for errors or damages caused by third-party actions.

HSL is only liable to Users for direct damages that it has caused intentionally or for damages resulting from gross negligence in violation of these Terms of Use.

6 Other rights of HSL and the Service Provider and limitations on liability

HSL or HSL’s partner Service Provider maintaining the Bicycle Garage, is not liable for any damages resulting from the use of the Service.

HSL reserves the right to exclude a User from the Service and/or impose an immediate ban on their use of the Service if the User violates the obligations defined in the Terms of Use.

HSL or the Service Provider does not guarantee that the Service will operate without errors or interruptions. HSL is not liable for any Service interruptions or other similar disturbances and errors, nor for damages that may arise from them. Additionally, HSL is not liable for errors or damages caused by third-party actions.

HSL is only liable to Users for direct damages that it has caused intentionally or for damages resulting from gross negligence in violation of these Terms of Use.

The User can obtain more information and assistance regarding the use of the Service on the Service's website or by contacting HSL's customer service. Contact information and opening hours are available on HSL's website and on the information boards at the Bicycle Garage doors.

Fees

The Bike Parking Service and Bicycle Garages are free to use and do not require a valid travel entitlement.

The Service Provider may offer additional services in the Bicycle Garage that are independent of the Bike Parking Service, such as charging lockers for electric bike batteries and storage lockers for bicycle helmets and other accessories.

There may be services in the Bicycle Garages provided by companies independent of HSL or the Service Provider, such as bike repair services, which charge fees according to their price lists.

Obligations and liabilities of the User

The User is obliged to comply with the rules specific to each Bicycle Garage. 

The User must conduct themselves in the Bicycle Garages in accordance with the law and with good manners.

The User has the right to use the Bicycle Garages during their opening hours.

If the User loses the HSL card used as an identifier, the User must remove the HSL card from the Service or replace the card linked to the Service. 

The identifier used to unlock the Bicycle Garage doors must not be shared with anyone else. In the event that the User loses their identifier or forgets their PIN code, they must update their HSL identifier information in the Bike Parking Service.

If the Bicycle Garage door does not open due to a system malfunction, the User must contact HSL's customer service according to the instructions provided on the Bicycle Garage door.

The storage time for bicycles may vary by Bicycle Garage. Once the storage time has expired, bicycles may be removed following the procedures for dealing with abandoned bicycles. The storage time and the procedures for removing bicycles are outlined in the Bicycle Garage rules. The User can then retrieve their bicycle from the location specified in the rules after paying the applicable removal and storage fees in accordance with current practices. Any other items left in the Bicycle Garage will be taken to the lost property service specified in the Bicycle Garage rules.

In the Bicycle Garage, bikes are secured with the User's own lock, and the storage of bikes in the Garage is at the User's responsibility.

The User is responsible for any damages caused to the Service or the Bicycle Garage operator intentionally or through gross negligence.

7 Complaints

Complaints and feedback related to the Bike Parking Service can be made on HSL's website at www.hsl.fi/en/customer-service/feedback.

8 Responsibility for stored property

The User is responsible for the property left in the Bicycle Garage. HSL or the Partner responsible for the Bicycle Garage is not responsible for bicycles or other property left in the Bicycle Garage.

9 Applicable law, settling of disputes and amending the Terms of Use

These Terms of Use and the Service are governed by Finnish law. Any disputes related to the use of the Service shall be settled primarily through negotiations between the parties. Disputes not settled by negotiation may be submitted to the Consumer Disputes Board or the Helsinki District Court for resolution.

HSL reserves the right to amend these Terms of Use as it develops the Bike Parking Service. The amended terms take effect upon publication on HSL’s website.

The Service Provider has the right to amend any terms related to the Bicycle Garage that pertain to the Service Provider's responsibilities. The Service Provider will notify Users of the changes on the Service website.
